These Terms apply to your access to and use of the TrobexisOne Mobile App (App). By using the App, you expressly agree to be bound by these Terms and our Privacy Policy, as amended.
To use the App, you will need at least an Apple device with iOS 26 (or a later version) installed or an Android device running the Android 16 operating system (or a later version), that is enabled for cellular or wireless internet connection (Device). While the App is compatible with the Android and the iOS operating systems specified above, Trobexis does not warrant or guarantee that the App will operate as intended on all Android or iOS devices.
The App may contain links to third party sites. If you click on a link to another site, you will leave the App. Your use of the third party site is not governed by these Terms. Trobexis will have no liability to you for any third party sites.
1. Licence
Subject to your compliance with these Terms, Trobexis grants to you a limited, non-exclusive, non-transferable licence to download and install a copy of the App on a Device that you own or control and to run such copy of the App solely for your own internal business purposes.
2. Your Account
2.1 Unless the Customer uses Single Sign-On (SSO), your access to the App will be via the account credentials (user ID and password) that you use to log into TrobexisOne. If you do not have access to TrobexisOne, Trobexis will provide you with account credentials so that you can access the App. If the Customer uses SSO to access TrobexisOne, your access to and use of the App will be via SSO.
2.2 You must keep your account credentials confidential and must not allow another person to use your account. You may change your password at any time by following the instructions in the App or in TrobexisOne (you will need to update your TrobexisOne account credentials).
2.3 There is a limit of one account per User. You must not create or attempt to create more than one account. A User who creates or uses more than one account will be barred from use of the App.
2.4 If you use the App on behalf of or as an agent of a company, by doing so you warrant and represent that you have the full authority and capacity to use the App on behalf of that company.
2.5 You agree that:
(a) you are fully responsible for all the activities resulting from any access to or use of the App through your account and under your user ID;
(b) when you access the App, you may remain logged into the App even after closing the App (unless you log out of the App prior to leaving it); and
(c) you accept full responsibility for all activities on the App while you are logged in (whether by you or another person).
2.6 You agree to immediately notify Trobexis of any unauthorised use of account credentials, account or any other breach of security of which you become aware in relation to the App.
3. Fees
3.1 Trobexis does not charge a separate fee to Users to download, access and use the App. The fees payable by the Customer to Trobexis under the relevant agreement granting access to and use of TrobexisOne covers your access to and use of the App.
3.2 You may incur charges from your mobile service provider for downloading and using the App. Any such charges are your sole responsibility and any matters regarding those charges should be raised with your mobile service provider.
4. Acceptable uses
You must use the App in accordance with these Terms, all applicable laws and regulations and any App safety implementations and settings that may apply.
5. Unacceptable uses
You must not in relation to your use of the App:
5.1 act in a manner that violates any applicable laws or regulations or these Terms;
5.2 violate copyright, trade mark or other intellectual property rights of Trobexis or any third parties;
5.3 illegally store, use or distribute software owned by or licensed to Trobexis;
5.4 transmit threatening, obscene, defamatory or offensive materials;
5.5 store any other User’s personal information without their prior consent;
5.6 damage, modify or destroy any of Trobexis’ or any other person’s files, data, passwords, devices or resources;
5.7 initiate or spread computer worms, viruses or other types of malicious programs;
5.8 make transmissions of any type or quantity which adversely affect the operation of the App or jeopardise the use of the App, or its performance for other Users;
5.9 violate the security of the App or other Users;
5.10 avoid, bypass, remove, deactivate, impair, descramble, or otherwise circumvent any technological measure implemented by Trobexis or any of Trobexis’ providers or any other third party (including another User) to protect the App; or
5.11 decipher, decompile, disassemble or reverse engineer any of the software used to provide and operate the App; or
5.12 attempt to do any of the above.
6. Updates
6.1 Trobexis may update the App software from time to time to vary features and functionality. The App may automatically download and install updates from time to time. These Terms will apply to any App updates.
6.2 You must accept any update or alterations to the App by Trobexis to continue using the App. If you do not accept any update or new release of the App, Trobexis may restrict or terminate your access to the App.
7. Intellectual property
7.1 All intellectual and industrial property rights arising from or subsisting in the App and TrobexisOne, including (without limitation) any business names, files, data, copyright, any trade marks, photographic images and any other registered or unregistered intellectual property rights in or associated with the App and TrobexisOne (Intellectual Property Rights) are owned by Trobexis.
7.2 You must not do or allow any third party to do anything that may infringe, damage or endanger Trobexis’ Intellectual Property Rights.
7.3 You represent and warrant that:
(a) you have the right to upload any data to the App through your account; and
(b) data uploaded to the App by you or otherwise through your account does not infringe on any third party’s intellectual property rights.
7.4 Trobexis does not own any Intellectual Property Rights in any data that Users upload to the App.
7.5 You grant to Trobexis a perpetual, worldwide, royalty free licence to use any data uploaded to the App for the purpose of Trobexis making the App and TrobexisOne available to you and making improvements to the App and TrobexisOne.
8. User supplied information
8.1 Trobexis has no control over the information or data provided by a User including the address or message content provided by a User. Trobexis accepts no responsibility for the content provided, printed, sent or received in relation to the App. By accessing or using the App you accept all responsibility, risk and liability for the content added, edited, provided, uploaded or modified by you.
8.2 Trobexis reserves all rights to remove, amend or alter User content on the App, to claim damages and/or apply for other legal remedies in respect of such material in accordance with these Terms.
9. Security
The security of User information is important to Trobexis. Trobexis takes all reasonable steps to ensure the security of our systems and the information Users upload via the App. Any information which we hold for you is stored on secure cloud-based servers and kept strictly confidential.
10. No representations and warranties
To the maximum extent permitted by law, Trobexis:
10.1 does not provide any representations or warranties relating to the App or any use of the App;
10.2 makes no representations or warranties as to the online availability of the App; and
10.3 will not be responsible in any way for the lack of or interruption to the availability of the App or any services which are provided on the App.
11. Trobexis Release
To the maximum extent permitted by law:
11.1 you agree to release and hold Trobexis harmless from and against all liability for any damages, costs, actions, claims that have arisen or may arise in respect of your use of the App or any use of your account that is in contravention with these Terms;
11.2 Trobexis will not be liable for and you release Trobexis from all damages, losses, actions, costs, claims, demands and causes of action whatsoever at law, in equity or under statute (including indirect or consequential damages) which you or anyone claiming through you may have, or might at any time have or have had against any Trobexis in respect of, arising out of or resulting from your download, use or attempted use of the App or any data on it.
12. General principles of use
12.1 Trobexis is not responsible and accepts no liability to any person for any material or data uploaded to or generated by use of the App. Trobexis reserves the right, but has no obligation, to monitor the material and data uploaded to or generated by use of the App.
12.2 You must comply with all third party service providers’ terms of use (e.g. network service providers) when using the App and you indemnify Trobexis against any loss or damage that Trobexis may suffer or incur arising from your failure to comply with the terms of use of any third party service providers.
13. Enforcement of these Terms
13.1 Trobexis may (but is not obliged to) monitor your use of the App to determine whether these Terms are being followed. If Trobexis monitors your use, Trobexis will safeguard your privacy unless doing so would involve Trobexis concealing a criminal offence or inhibiting the enforcement of these Terms.
13.2 If Trobexis becomes concerned that your use of the App may break the law or is inconsistent with these Terms, Trobexis will generally attempt to contact you before taking action.
13.3 If Trobexis believes that your use of the App may break the law or that you have not complied with these Terms Trobexis may:
(a) notify you by email;
(b) remove, amend or alter any material or data in the App that Trobexis considers (in its sole discretion) to be in violation of these Terms without notice;
(c) suspend or terminate your access to the App without notice; and/or
(d) notify and provide relevant information to the authorities, as appropriate in the circumstances.
13.4 If Trobexis takes action under this clause 13 or clause 14, Trobexis reserves the right, in its sole discretion, to delete any or all of your data, software or other content stored by Trobexis.
14. Trobexis’ rights
14.1 Without limiting any of Trobexis’ other rights, if you breach any term of these Terms, Trobexis will have the right to:
(a) confiscate or destroy or require you to return or destroy, at your cost, all material that you have obtained from the App;
(b) require you to delete or otherwise permanently remove from any electronic device, information you have obtained from the App;
(c) suspend or terminate your access to the App; and
(d) take any other action against you.
14.2 To the maximum extent permitted by law, you indemnify Trobexis against all damages, losses, actions, costs, claims, demands and causes of action whatsoever at law, in equity or under statute that Trobexis may suffer or incur as a result of any breach of these Terms by you.
15. Termination
15.1 These Terms are effective until terminated in accordance with this clause 15. Trobexis may terminate these Terms at any time if you are in breach of these Terms. Upon or at any time after termination for any reason, you must delete the App and any backup copies of the App if required by Trobexis.
15.2 Upon any termination, the rights and licences granted to you by these Terms will terminate and you must cease all use of the App.
15.3 All provisions of the Terms which by their nature should survive termination will survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
16. Limitations
16.1 While Trobexis will make commercially reasonable efforts to give notice on the App, Trobexis may from time to time suspend any or all of the services provided on the App or disconnect or deny access to the App, without notice to you during any technical failure, modification or maintenance affecting the App. Trobexis will use commercially reasonable endeavours to procure the resumption of the App as soon as reasonably practicable.
16.2 Trobexis will use commercially reasonable endeavours to maintain the performance of the App where this is within Trobexis’ direct control.
16.3 Trobexis cannot and does not warrant that the App will operate error-free or that the App and its server are free from computer viruses or other harmful mechanisms.
16.4 To the maximum extent permitted by law, Trobexis will not be responsible for any inability of your Device to access or use the App, or for any loss or damage to your Device resulting from your access or use, or attempted access or use, of the App (including downloading any associated applications for the App).
17. General
17.1 Trobexis may amend these Terms at any time. The latest version of these Terms will be available at www.gettrobexis.com.
17.2 Trobexis may assign, novate, sub-licence or otherwise transfer its rights in respect of these Terms without notice to you or without your consent.
17.3 These Terms constitute the entire agreement between you and Trobexis in relation to your access and use of the App.
17.4 No right under these Terms will be deemed to be waived except by notice in writing signed by each party. A waiver by Trobexis pursuant to this clause will not prejudice its rights in respect of any subsequent breach of these Terms.
17.5 If any provision of these Terms is held to be invalid, unenforceable or illegal for any reason, these Terms will remain otherwise in full force apart from such provisions which will be deemed to be deleted.
17.6 These Terms are governed by the laws of Victoria. The User irrevocably consents to the non-exclusive jurisdiction of the courts of Victoria for the purpose of any legal action arising out of or related to the use of the App or these Terms.

19. Definitions
Customer means the party specified in an agreement with Trobexis pursuant to which Trobexis grants to the Customer access to and use of TrobexisOne.
Trobexis means Trobexis Ltd ACN 606 279 841, a company registered in Australia with its registered office at 6 Chastleton Avenue Toorak Victoria 3142.
TrobexisOne means TrobexisOne Enterprise Solution.
us, we, our means Trobexis.
User means an individual employed or otherwise engaged by the Customer who is granted access to and use of the App by Trobexis.
you, your means any individual or entity accessing or using the App for any reason, including the Customer and any User.
